Terms of Service

These terms govern your use of Dayfolds. Dayfolds is a product of VISK, registered with the Dutch Chamber of Commerce (KVK) under number 86233890. By creating an event, scanning a QR code to upload something, or otherwise using Dayfolds, you agree to these terms. If you do not agree to them, please do not use the service.

1. What Dayfolds is

Dayfolds lets a host create a private, browser-based gallery for an event. Guests scan a QR code and upload photos, videos, voice messages, or written notes without needing to create an account. The host can moderate what is shared, view everything in a shared gallery, optionally display it as a live slideshow, and download everything afterward.

2. Accounts

You need an account to create and manage events as a host. You are responsible for keeping your login secure and for anything that happens under your account. Please let us know right away at hello@dayfolds.com if you believe your account has been accessed without your permission. Guests do not need an account to upload to an event.

3. Payment and event activation

You can build and preview an event for free. Publishing an event so guests can actually upload to it requires a one-time payment per event, shown at checkout before you pay. We do not use subscriptions or hidden tiers, the price you see is what unlocks the full feature set for that event. Payments are processed by Stripe. Because event creation and QR code generation happen before payment, and because activation unlocks digital access immediately, we generally do not offer refunds once an event has been activated, except where required by law or where we conclude, at our discretion, that something on our end genuinely went wrong. If you think a charge was incorrect, email us and we will look into it in good faith.

4. Content you and your guests upload

You and your guests keep ownership of whatever photos, videos, voice messages, or notes get uploaded to an event. By uploading, you grant Dayfolds a license to store, process, and display that content back to the host and anyone the host allows to view the gallery, solely for the purpose of operating the service. We do not claim ownership of your content and we do not use it for anything beyond running the event gallery you set up, such as marketing, without asking you first.

As the host, you are responsible for making sure you have the right to collect content from your guests for your event and for how you use the gallery afterward. Dayfolds is a tool for hosting and moderating event media, not a publisher of it, and we are not able to review every upload before it happens.

5. Acceptable use

Please do not use Dayfolds to upload or share anything illegal, anything that infringes someone else's rights, or anything intended to harass, threaten, or exploit another person. Do not try to break, overload, or reverse engineer the service, or use it to send spam or malware. Hosts are encouraged to turn on the optional review setting if they are concerned about what guests might upload. We may remove content or suspend an account that we reasonably believe violates this section.

6. Moderation

Hosts can choose to review uploads before they appear in the gallery, or let uploads appear immediately. Either way, the host can hide or delete individual uploads at any time from their dashboard. We do not actively monitor every event's gallery, so responsibility for moderating an event's content day to day sits with the host, though we may step in if content is reported to us and clearly breaches section 5.

7. Data retention

Event media is available for 3 months from the event date (details in our Privacy Policy), after which it is permanently deleted. We recommend downloading your full archive before this window closes. Once media is deleted from our systems, we are not able to restore it.

8. Availability of the service

We aim to keep Dayfolds available and working reliably, including handling flaky venue wifi gracefully with resumable uploads. That said, Dayfolds is provided on an "as is" and "as available" basis. We do not guarantee the service will be uninterrupted, error-free, or available at all times, and we may need to perform maintenance or make changes to the service from time to time.

9. Limitation of liability

To the extent permitted by law, Dayfolds and VISK are not liable for indirect, incidental, or consequential damages arising from your use of the service, including loss of photos, videos, or other content, except where that loss is caused by our gross negligence or willful misconduct. We encourage hosts to download their event archive promptly, since we cannot guarantee media will remain available beyond the retention period described above. Nothing in these terms limits any liability that cannot legally be limited or excluded.

10. Termination

You can stop using Dayfolds at any time. We may suspend or close an account if we reasonably believe it is being used in violation of these terms, or if we are required to do so by law. If we close your account for reasons other than a violation of these terms, we will try to give you a reasonable opportunity to download your event data first.

11. Changes to these terms

We may update these terms as Dayfolds evolves. If we make a change we consider significant, we will update the date at the top of this page and, where reasonably possible, let existing hosts know. Continuing to use Dayfolds after a change means you accept the updated terms.

12. Governing law

These terms are governed by the laws of the Netherlands. If a dispute cannot be resolved informally, it will be brought before the competent court in the Netherlands, without prejudice to any mandatory consumer protection rights you may have in your own country of residence.
